TERMS OF USE Use of this site signifies your agreement with the following terms of use. If you do not agree with any of these terms of use, please do not use this site. HoCoMoJo and its affiliate publications (the “Company”) reserves the right, in its sole discretion, to modify these Terms of Use at any time and you agree to be bound by such modifications through your use of the Company’s site. The Company may require you to register and provide certain information to it as a condition of using or accessing certain features, functions and content. User Discussion and Submission Guidelines We invite you to submit your videos, photos, articles, and comments in certain areas of our website. It is our hope that you'll take the opportunity to contribute to these interactive forums and share your original content with our community. In order to keep these interactive forums enjoyable and interesting for all of our users, we ask that you follow the rules outlined below. By submitting content, you are consenting to these rules: You agree not to submit inappropriate content. Inappropriate content includes any content that: • infringes upon or violates the copyrights, trademarks or other intellectual property rights of any person • is libelous or defamatory • is obscene, pornographic, or sexually explicit • violates a person's right to privacy • violates any local, state, national, or international law • contains or advocates illegal or violent acts • degrades others on the basis of gender, race, class, ethnicity, national origin, religion, sexual preference, disability, or other classification • is predatory, hateful, or intended to intimidate or harass • contains advertising or solicitation of any kind • misrepresents your identity or affiliation • impersonates others You agree that you are fully responsible for the content that you submit. You will promptly remove any content that you have posted should you discover that it violates these rules or that it is otherwise inappropriate. You will indemnify HoCoMoJo and its parent and affiliates, and its and their directors, officers, managers, employees, shareholders, agents, and licensors, from and against losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any claim brought You understand and agree that we are not responsible for any user submitted content. You further understand that we have the right, but not the obligation, to monitor submissions and we may remove content that we deem inappropriate for any reason whatsoever without consent. We further reserve the right, in our sole discretion, to remove a user's privilege to post content on our site. You certify that you are at least 13 years of age. If you are under the age of 13, please do not submit any content to us. If you are under the age of 18 but at least 13 years of age, you may submit content only with the permission of, and under the supervision of, a parent or legal guardian. If you are a parent or legal guardian agreeing to these rules for the benefit of an individual between the ages of 13 and 18, please be advised that you are fully responsible for his or her submissions and any legal liability that he or she may incur. You certify that you have the permission of others who have contributed to or are featured in any content that you submit. If there are any individuals under the age of 18 in any photos, video, or other content that you submit, you must obtain the permission of each such individual's parent or legal guardian prior to submitting the content. You acknowledge and agree any use and/or reliance on any information obtained through the interactive forums at your own risk. We are not in any manner endorsing the content of the interactive forums and cannot and will not vouch for its reliability. For any content that you submit, you give us permission to use such content. You hereby grant to HoCoMoJo a royalty-free, irrevocable, perpetual, worldwide, exclusive, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, incorporate into other works, distribute, perform, display, and otherwise exploit such content, in whole or in part in any form, media or technology now known or later developed. Agree not to solicit others. You agree not to use this site’s commenting features to advertise or to solicit anyone to buy or sell products or services, or to make donations of any kind, without the Company’s express written approval; Agree not to have multiple personalities on our site’s commenting features. Each reader may have only one log-in. If you would like to change handles, please e-mail us. Usage of multiple log-ins will result in our removing your posting privileges under any screen name. We also reserve the right to pull postings from handles which themselves might be considered objectionable; Agree not to upload, post, distribute, e-mail or otherwise publish or make available through this site any libelous, defamatory, obscene, harmful, vulgar, threatening, tortious, harassing, abusive, invasive of another’s privacy, hateful, racially or ethnically objectionable, or otherwise illegal material; Agree not to post in manner than emulates, purports or pretends to be someone else. Under no circumstances are readers posting to this site to knowingly use the name or identity of another person, whether that is another reader on this site, a public figure, celebrity, elected official, etc … This also means that readers will not knowingly give out any personal information of other members of these forums. Agree to be nice. Yes, it is OK to have an intelligent discussion where points are debated. The management and editors of HoCoMoJo want and encourage that. As stated on nearly every page of this site where readers can post, our goal is not to limit the discussion, but rather to elevate it. Comments should be relevant and contain no abusive language. Agree not to use this forum for personal attacks. This includes any sort of personal attack — including, but not limited to the people in our stories, the journalists who create these stories, or anyone else in this community. The management and editors of HoCoMoJo retain the right to remove individual posts or to revoke the access privileges of anyone who we believe has violated any of these terms or any other term of this agreement. LICENSE For all such information and material, you grant HoCoMoJo, its affiliates and related entities, and its affiliated newspaper, a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, copy, modify, display, archive, store, distribute, reproduce and create derivative works from such information, in any form, media, software or technology of any kind now existing or developed in the future. NO PRE-SCREENING OR EDITING This site offers weblogs, forums, photo galleries and other interactive areas where users can express opinions and share ideas and information. HoCoMoJo cannot and does not monitor all of the material posted or transmitted to the Site. Additionally, HoCoMoJo does not control, and is not responsible for, Content made available through the Site by members. By using the Site, you may be exposed to Content that you may find offensive, indecent, inaccurate, misleading, or otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of the Site and any of its Content, including but not limited to whether you should rely on said Content. You also agree that under no circumstances will HoCoMoJo or its affiliates be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, e-mailed or otherwise made available via the Site. You acknowledge that Provider does not pre-screen or approve Content, but that the Company shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any Content that is available via the Site, for violating the letter or spirit of the Terms or for any other reason. The Company reserves the right to delete any posting, message or photograph at any time, for any reason or no reason. TERMINATION HoCoMoJo may, in its sole discretion, terminate or suspend your access to all or part of the site, including, but not limited to, any bulletin boards on its site, for any reason, including without limitation, breach of this agreement. In the event this agreement is terminated, the restrictions regarding Materials appearing on the site, and the representations and warranties, indemnities, and limitations of liabilities set forth in this agreement shall survive any such termination. JURISDICTION This site is controlled and operated by HoCoMoJo from the Company’s headquarters in Columbia, MD. HoCoMoJo does not represent or warrant that Materials on the site are appropriate or available for use in other locations. If you choose to access this site from other locations, you do so at your own risk and are responsible for compliance with any and all local laws. This agreement shall be governed by and construed in accordance with the laws of the State of Maryland, as it is applied to agreements entered into and performed within that State. Any action brought to enforce this agreement or matters related to the site shall be brought in either the State or Federal Courts of Maryland. If any provision of this agreement is deemed void, unlawful or otherwise unenforceable for any reason, that provision shall be severed from this agreement and the remaining provisions of this agreement shall remain in force. This contains the entire agreement between you and the Company concerning your use of the site. Events While HoCoMoJo will make every effort to ensure the accuracy of the information on all local events, HoCoMoJo (nor its employees or agents) will not be liable for any inaccuracies. HoCoMoJo cannot accept responsibility for the contents of any linked website. The existence of a link does not imply any endorsement or recommendation of the organization or the information or views which may be expressed in any linked website.
